ShootPal Terms of Service

1. Acceptance of Terms

By creating an account or using ShootPal (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

ShootPal is a business-management application for photographers, offering educational reference tools, photography calculators, shoot and project tracking, workflow checklists, client management, expense and mileage tracking, and related features, offered across Free, Plus, and Studio subscription tiers.

3. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

4. Subscriptions and Billing

  • ShootPal offers a Free tier and paid Plus ($4.99/month) and Studio ($9.99/month) subscription tiers, each unlocking additional features as described within the Service.
  • Paid subscriptions are billed monthly in advance and processed through Stripe, Inc.
  • You may cancel your subscription at any time through the Service; cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that date.
  • Fees are non-refundable except as required by law.
  • We reserve the right to change subscription pricing with advance notice.

5. Your Content and Data

You retain ownership of the content and data you enter into ShootPal, including project details, client information, notes, and photos ("Your Content"). You grant ShootPal a limited license to store, process, and display Your Content solely for the purpose of operating the Service.

You are solely responsible for:

  • The accuracy of Your Content
  • Having the legal right to store and process any information about third parties (including your own clients) that you enter into the Service
  • Complying with applicable privacy and data protection laws with respect to Your Content

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or other users' data
  • Interfere with or disrupt the operation of the Service
  • Use the Service to store or transmit information you do not have the right to store or transmit

7. Third-Party Services

The Service integrates with third-party services, including Stripe (payments) and Google (authentication and location services). Your use of these integrations is also subject to the respective third party's terms and policies.

8. Intellectual Property

ShootPal and its original content, features, and functionality are owned by Andrew Smith Creative Co. and are protected by applicable intellectual property laws. These Terms do not grant you any rights to ShootPal's trademarks, logos, or branding.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. ShootPal does not guarantee the Service will be uninterrupted, error-free, or secure. Educational content and calculators are provided for general reference only.

10. Limitation of Liability

To the fullest extent permitted by law, ShootPal and its owner(s) shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service.

11. Termination

We may suspend or terminate your account for violation of these Terms. You may stop using the Service and cancel your account at any time.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law principles.
